The teachings, guidance, and practices provided through our courses and workshops, whether online or in-person, are based on personal interpretations of spiritual principles and yoga practices. 2. Participant Responsibilities
Sacred Wisdom Protection
Participants acknowledge that the teachings provided in all Papnejaโs Path courses are sacred wisdom passed down through Dr. Papneja. You agree not to disseminate, replicate, or teach any part of the course without explicit permission from Dr. Papneja. Additionally, you agree to refrain from posting reviews of any kind, and Papnejaโs Path reserves the right to request the removal of any such posts.
Non-Discussion Clause
You agree not to create blogs, forums, or any public or private discussions about course content or your experiences, either online or offline.
3. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. By accessing and using our services, you agree to submit to the exclusive jurisdiction of the courts located in Mississauga, Ontario, Canada for the resolution of any disputes.
4. Binding Arbitration
Any disputes arising out of or relating to these terms, including breach or termination, shall be resolved through binding arbitration. The arbitration shall take place in Mississauga, Ontario, Canada, and the language of the arbitration shall be English. The decision of the arbitrator(s) shall be final and binding.
5. Health and Safety
Participation in our courses may involve physical exertion and practices such as yoga and kriyas. Participants acknowledge the risks involved and are responsible for disclosing any pre-existing health conditions. Papnejaโs Path does not provide medical advice; it is your responsibility to consult a healthcare provider before beginning any new physical practice. We are not liable for injuries or adverse effects.
Assumption of Risk
By participating, you voluntarily assume all risks associated with yoga practices and other physical exercises. You agree to modify or discontinue practices as needed if you experience discomfort, pain, or other adverse effects. We are not liable for any resulting injuries or effects from failure to adjust your practice.
6. Waiver of Claims
By enrolling in any Papnejaโs Path course, you waive all rights to file claims for physical injury, mental distress, personal harm, or any other related claims. This waiver extends to any injuries resulting from course activities or your own actions.
7. Waiver of Liability for In-Person Events
If you attend our in-person events, workshops, or retreats, you acknowledge and agree to the following:
- Voluntary Participation: You understand that your participation is voluntary and assume full responsibility for any injuries or adverse effects that may occur.
- Release of Liability: To the fullest extent permitted by law, you release Papnejaโs Path, its owners, employees, and agents from any claims arising from your participation in in-person events.
- Responsibility for Safety: You agree to follow all instructions and safety guidelines provided by our instructors.
- Binding Arbitration: Any disputes related to in-person events will be resolved through binding arbitration as outlined in these terms.
8. Refund Policy
Non-Refundable Courses: All courses, both online and in-person, are non-refundable. By enrolling in our offerings, you agree that your decision is final and waive any rights to request refunds or initiate chargebacks. If you are unable to attend, rescheduling is allowed at our discretion, and rescheduling fees may apply.
Inner Experience: Welcome Course: Enrollment in this free course is final, and by participating, you waive any right to take legal action against Papneja’s Path or any of its affiliates, properties, or associated courses or services in any form.
9. Anahata Shabda and Lifelong Commitment
The Anahata Shabda is a central part of our spiritual curriculum. It is a sacred transmission, and achieving the ability to perceive it is a profound spiritual journey that varies for each individual based on their karmas and readiness. By enrolling, you commit to the lifelong dedication required for spiritual growth. Inconsistency in adhering to practices may hinder your progress.
10. Online Yoga Content Disclaimer
Our online yoga content is for informational purposes only. The results and benefits of yoga vary from person to person. You are responsible for consulting with a healthcare provider before engaging in yoga practices. We make no guarantees of specific outcomes.
Personal Responsibility
You are responsible for modifying or discontinuing any yoga practices that cause discomfort or adverse effects. We are not liable for injuries resulting from online yoga practices.
Limitation of Liability
To the fullest extent permitted by law, Papneja’s Path disclaims liability for injuries or adverse effects arising from your use of online content.
11. Waiver of Liability for Online and Physical Yoga Instruction
By participating in yoga instruction, whether online or in person, you voluntarily assume all risks. You acknowledge the inherent risks of physical activities such as yoga, and release Papnejaโs Path from all claims related to injuries or adverse effects.
12. General Safety Guidelines for Yoga Instruction
- Informed Participation: You agree that you have read and understood all safety guidelines provided before participating in yoga sessions.
- Instructor Guidance: You agree to follow the instructions of our yoga instructors and clarify any poses if unsure.
- Personal Responsibility: You are responsible for monitoring your physical condition and modifying or discontinuing practices as needed.
13. Integration of Online and Physical Courses
Participants acknowledge that the journey towards perceiving the Anahata Shabda is not complete until both the online and in-person components are fulfilled. Upon completing the online course, participants can transition to the physical course by notifying Papnejaโs Path. Adjustments to fees for transitioning may apply, subject to current terms.
14. Special Considerations for Free Courses
Participants enrolled in free any courses or complete any segment of a course for free, acknowledge that by accessing and completing the free course, they waive all rights to pursue any legal action or claims against Papnejaโs Path, its affiliates, properties, or any related services or courses. This waiver applies to all current and future claims, including those related to paid courses, workshops, or any other services offered by Papnejaโs Path. By participating in the free course, participants fully relinquish the right to initiate lawsuits or claims in connection with any of Papneja’s Path’s offerings, whether free or paid
Conclusion:
These Terms and Conditions protect Papnejaโs Path from liability and litigation. By enrolling in our courses and accessing our content, you affirm that you have read, understood, and agreed to these terms. This agreement supersedes any previous agreements or understandings.
